VEHICLE SALES AGREEMENT

This Vehicle Sales Agreement (“Agreement”) is a legal contract between Vehicle Online Auction LTD, a registered company in the United Kingdom with its head office at 414-416 Blackpool Road, Ashton-On-Ribble, Preston, England, PR2 2DX (“vehicleonlineauction.co.uk”), and the undersigned Seller (“Seller”). This Agreement governs the terms and conditions for selling the Seller’s vehicle on the online auction platform known as vehicleonlineauction.co.uk or VOA.com.

  1. TRADE-ONLY ACCESS

Vehicleonlineauction.co.uk and VOA.com, operating as trade-only platforms under Vehicle Online Auction LTD, explicitly restrict private sellers from accessing the platform.

  1. AUCTION DURATION

The Seller is granted the flexibility to set the auction duration for their listed vehicle, choosing from options of 1, 3, 5, 7, or 10 days.

  1. RESERVE PRICE

The “Reserve Price” is the minimum amount at which a provisional offer will be considered. Vehicleonlineauction.co.uk ensures the Seller is promptly notified of any offers meeting or exceeding the Reserve Price.

  1. BIDDING PROCESS

Dealers engage in the auction process. In the case of a set Reserve Price, the vehicle will not be sold below that amount unless the Seller opts to adjust it before the auction concludes.

  1. CONTROL OVER PRICING

The Seller retains complete control over the pricing strategy for their listed vehicle.

  1. COMMUNICATION

Upon the receipt of an offer meeting or surpassing the Reserve Price, vehicleonlineauction.co.uk initiates contact with the Seller via phone to confirm the offer.

  1. OFFER ACCEPTANCE

Upon acceptance of an offer, a conditional provisional offer acceptance email is dispatched to the Seller, who is then required to sign and confirm acceptance.

  1. DEALER CONTACT

All aspects of auction reserve prices and sales are managed exclusively by the vehicleonlineauction.co.uk (VOA.com) team, operating under the trading name Vehicle Online Auction LTD. Security information is seamlessly included in dealer contact emails to safeguard the interests of both parties.

  1. SECURITY INFORMATION

Dealer contact emails include vital security details aimed at ensuring the protection of both the Seller and the dealer.

  1. REGISTERED OFFICE

  1. SELLER ELIGIBILITY

  1. ADDITIONAL SERVICES

Vehicleonlineauction.co.uk extends services beyond auctions, including free classified ads, car leasing, and brokerage services.

  1. HPI AND INSURANCE DATABASE CHECKS

All vehicles listed undergo comprehensive and free HPI and insurance database checks. Any instances of fraud or misrepresentation will be promptly reported to the relevant authorities.

  1. LISTING FEES AND SELLER FEES

Private sellers benefit from a full waiver of all fees. Vehicleonlineauction.co.uk explicitly disclaims any responsibility for the financial aspects of transactions, putting the onus on the Seller and the dealer.

  1. CONFIRMATION OF SALE

Post-transaction, no fees are deducted from the selling price.

  1. RIGHTS AND RESPONSIBILITIES

Users, in agreeing to these terms, accept responsibility for the accuracy of their listings and pledge to respect intellectual property rights. Any misuse may result in suspension.

  1. PRIVACY RIGHTS

  1. TERMINATION OF SERVICE

TERMS OF FREE AUCTION ENTRY AND LISTING ACCEPTANCE

This document outlines the terms for the free auction entry service provided by Vehicle Online Auction LTD (“the Auction Platform”). The Seller is advised to review these terms before utilizing the service:

  1. LISTING DEADLINE

All vehicle listings must be submitted and accepted by 18:00 on the day preceding the auction commencement.

  1. LISTING REQUIREMENTS

Each listed vehicle must be accompanied by a minimum of 10 pictures provided at the time of completing the form.

  1. ACCEPTED VEHICLES

The Auction Platform extends its services to various vehicle types, including cars, vans, and commercial vehicles.

  1. RESERVE PRICE

The reserve price, set by the Seller, serves as the minimum amount at which a provisional offer will be considered. Sellers bear no obligation until the provisional offer is accepted.

  1. ACCEPTANCE AND OBLIGATION

Upon receiving and accepting an offer, the Seller becomes obligated to sell the vehicle to the dealer/purchaser at the agreed price. An email confirmation and acceptance are required for this commitment.

  1. RIGHT TO WITHDRAW – PRE-INSPECTION

The Seller retains the right to withdraw up until the point of inspection by the dealer. Withdrawal is permissible if the Seller is dissatisfied and decides not to proceed with the sale.

  1. INSPECTION WITHDRAWAL

If, during the inspection, either the Seller or the dealer is dissatisfied, either party reserves the right to withdraw from the sale.

  1. WITHDRAWAL CONDITIONS

Withdrawal is only valid when both parties mutually agree that the transaction is unsatisfactory.

  1. TRANSACTION COMPLETION

Once the dealer agrees to the price, the transaction is considered final and binding. This payment is non-refundable and irreversible under any circumstances.

  1. VEHICLE INTEGRITY

If the vehicle is found to be stolen, damaged, accident-damaged, or not declared, the dealer has the right to a full refund. In cases of fraud or illegal activities, appropriate authorities will be informed, and legal action or criminal prosecution may be enforced by the relevant authorities.
